color:#5F5F5F'>Tracy Doriot, 2010 BIA President<o:p></o:p></span></p> <p class=MsoNormal><o:p>&nbsp;</o:p></p> <p class=MsoNormal>With January drawn to a close I am invigorated by the successes we, as an association, have achieved and look forward to exciting opportunities in the current year and beyond.<span style='mso-spacerun:yes'>  </span>Our  Members Working with Members initiative has become so successful that we have created a new monthly networking-only event.<span style='mso-spacerun:yes'>   </span>Another resounding success is the recent disbursement of funds to companies and individuals who applied for the permit fee refund resulting from the BIA lawsuit against <st1:place w:st="on"><st1:PlaceName w:st="on">Clark</st1:PlaceName> <st1:PlaceType w:st="on">County</st1:PlaceType></st1:place>.<span style='mso-spacerun:yes'>  </span></p> <p class=MsoNormal><o:p>&nbsp;</o:p></p> <p class=MsoNormal>As I reflect on the past year I am gratified that the actions we undertook last year proved to be the right things at the right time.<span style='mso-spacerun:yes'>  </span>Careful and considered analysis by the Executive Board, Board of Directors, the Executive Director and the Finance Committee allowed us to make strategic decisions that will insure our association s ability to promote and protect our industry well into the future.</p> <p class=MsoNormal><o:p>&nbsp;</o:p></p> <p class=MsoNormal>With those mission objectives well in hand, my focus late last year shifted to analyzing foreseeable and manageable threats to the stability of the BIA.<span style='mso-spacerun:yes'>  </span>With input from the Finance Committee, it was determined that the mortgage on our office building constituted a significant drain on our yearly budget.<span style='mso-spacerun:yes'>  </span>Therefore, I asked the Past Presidents Council to examine the building and determine its suitability in meeting our current and future needs.<span style='mso-spacerun:yes'>  </span>The result of that analysis is while the building is larger that our current requirements potential threats to our industry in coming years will require more staff and therefore having that space available is important to our mission.<span style='mso-spacerun:yes'>  </span></p> <p class=MsoNormal><o:p>&nbsp;</o:p></p> <p class=MsoNormal>I feel it is mission critical to launch a campaign to retire the mortgage on our facility.<span style='mso-spacerun:yes'>  </span>I presented this concept to the Board of Directors at our January meeting.<span style='mso-spacerun:yes'>  </span>The Board overwhelmingly supported this campaign.<span style='mso-spacerun:yes'>  </span>As President, I put some  skin in the game <span style='color:red'> </span>by personally guaranteeing a minimum $1,000 contribution per year for the first three years.<span style='mso-spacerun:yes'>  </span>I was gratified by the level of support given this initiative by other board members.<span style='mso-spacerun:yes'>  </span>Many stepped up to match or exceed my level of commitment.<span style='mso-spacerun:yes'>  </span>It was recommended by the Past Presidents Council that we ask the membership for a $25 per year increase in our dues to partially fund this campaign.<span style='mso-spacerun:yes'>  </span>The  official building endowment campaign is in the planning stages and will be announced soon.<span style='mso-spacerun:yes'>   </span>While the final campaign will have many facets it is important to me that each and every member has a stake in this mission.<span style='mso-spacerun:yes'>  </span>This dues increase will make that a reality. </p> <p class=MsoNormal><o:p>&nbsp;</o:p></p> <p class=MsoNormal>I am proud that, together, we have taken the first step in a journey that will make such a profound difference to the Association.<span style='mso-spacerun:yes'>  </span>Please support both myself and the Board of Directors in this effort.<span style='mso-spacerun:yes'>  </span>At the February membership dinner I will ask for your support in the form of a  yes vote for this modest dues increase. When the opposite is occurring, and the status quo is insufficient, action is mandated. Such is the case with <st1:place w:st="on"><st1:PlaceName w:st="on">Washington</st1:PlaceName> <st1:PlaceType w:st="on">State</st1:PlaceType></st1:place> s worker s compensation program, administered by the Department of Labor and Industries.</p> <p class=MsoNormal><o:p>&nbsp;</o:p></p> <p class=MsoNormal>The worker s compensation program has been under the sole control of the state for almost a century and has effectively blocked out private insurers, thus creating a state-controlled monopoly. Unfortunately this lack of competition has created a disincentive for efficiency and accountability resulting in poor program management and increased costs  all of which have a negative impact on the building industry.</p> <p class=MsoNormal><o:p>&nbsp;</o:p></p> <p class=MsoNormal>Recent legislation (HB 2879), which sought to overhaul the existing worker s compensation market, was stopped by Democratic leadership favoring the existing program and heavily backed by organized labor. In response, the BIA has filed paperwork on a statewide initiative introducing private companies and competition into the worker s compensation market. States such as <st1:State w:st="on">Oregon</st1:State> and <st1:place w:st="on"><st1:State w:st="on">West Virginia</st1:State></st1:place>, where similar legislation has been passed, have seen decreased worker s compensation rates while promoting a safer working environment and promoting job growth. The refunds are in accordance with a settlement reached by <st1:place w:st="on"><st1:PlaceName w:st="on">Clark</st1:PlaceName> <st1:PlaceType w:st="on">County</st1:PlaceType></st1:place> and the Building Industry Association of Clark County in December 2008.<o:p></o:p></span></p> <p class=MsoNormal><span style='color:black'><o:p>&nbsp;</o:p></span></p> <p class=MsoNormal><span style='color:black'>About $874,500 is being refunded to businesses and individuals who purchased approximately 6,900 building permits.<o:p></o:p></span></p> <p class=MsoNormal style='margin-left:13.5pt'><span style='color:black'><o:p>&nbsp;</o:p></span></p> <p class=MsoNormal><span style='color:black'>The BIA charged that state law only allows fees for the cost of reviewing permit applications and plans and conducting inspections of the building project. A Cowlitz County Superior Court judge ruled that code enforcement activities completed prior to a building permit being issued are not part of the application process. Those activities are law enforcement related and cannot be paid for by building permit fees, the court ruled.<o:p></o:p></span></p> <p class=MsoNormal style='margin-left:13.5pt'><span style='color:black'><o:p>&nbsp;</o:p></span></p> <p class=MsoNormal><span style='color:black'>Subsequently, the county and association reached a settlement, and the court approved the county refunding the portion of the fee improperly used for code enforcement. Residential, commercial and remodel permit fees were eligible for the refund. Fees for plan review, plumbing, mechanical and other permits as well as impact fees were not eligible. Specifically, builders were asked to contact their members of Congress and urge them to strip an amendment from the Senate-passed health care bill written by Sen. Jeff <span class=SpellE>Merkley</span> (D-Ore.). The <span class=SpellE>Merkley</span> language unfairly targets small construction firms by requiring them to provide health insurance or face stiff fines if they employ more than five workers. Meanwhile, small businesses in all other industries would be exempt from providing mandatory health coverage if they employ 50 workers or less.</span></b><span style='font-size:9.0pt;font-family:Helvetica'> <o:p></o:p></span></p> <p>Thousands of letters were sent to members of Congress explaining how this amendment threatens the viability of countless small home builders across the nation and calling on Congress to strip this provision from the final health care bill. <span style='font-size:9.0pt;font-family: Helvetica'><o:p></o:p></span></p> <p>Complementing the grassroots push at the IBS, NAHB continues to work with lawmakers in both chambers to send a message to the Democratic leadership to delete the <span class=SpellE>Merkley</span> language from the final legislation.&nbsp;In the House, Rep. Bart Gordon (D-Tenn.) took the lead in sending a letter to House Speaker Nancy Pelosi (D-Calif.) and Senate Majority&nbsp;Leader <span class=SpellE>Steny</span> Hoyer (D-<span class=SpellE>Md</span>.) urging them to eliminate the <span class=SpellE>Merkley</span> amendment from the final measure. In the letter, Gordon and 15 other House members characterized this as a &quot;potentially devastating provision&quot; that &quot;unjustly targets an industry trying to keep its doors open during the worst downturn since the Great Depression.&quot;&nbsp; </p> <p>Sen. Blanche Lincoln (D-Ark.) spearheaded a parallel effort in the Senate. Lincoln, along with Sens. Mark Warner (D-Va.), Mark Pryor (D-Ark.) and Tim Johnson (D-S.D.) sent a similar letter to Senate Majority Leader Harry Reid (D-Nev.) in mid-January.</p> <p>Meanwhile, Republican Scott Brown s stunning upset last week in the special election to fill the Massachusetts U.S. Senate seat vacated by the death of Edward Kenney gives the GOP 41 Senate seats and has complicated efforts for the Democrats to get the 60 votes they need for a sweeping health care bill.
